These Terms of Service (“Terms”) apply to purchases from and use of the Plantstraws online store and website operated by Plantstraws AB, company registration number 559308-2141, VAT number SE559308214101, with its registered address at Norrbackagatan 9, 113 34 Stockholm, Sweden (“Plantstraws”, “we”, “us” or “our”).

By placing an order with us, you agree to these Terms. If you are purchasing as a consumer, nothing in these Terms limits or excludes any rights you have under mandatory consumer protection laws applicable to you.

1. Orders and Contract Formation

When you place an order, you will receive an order confirmation by email. A purchase agreement is formed when we confirm your order.

We reserve the right to decline or cancel an order where reasonably necessary, for example in the event of an obvious pricing or product information error, stock discrepancy, suspected fraud, or where we are unable to fulfil or legally accept the order. If payment has already been made for an order that we cancel, the amount paid will be refunded.

You are responsible for providing complete and accurate contact, billing and delivery information when placing an order.

2. Products, Prices and Availability

We make every reasonable effort to ensure that product descriptions, images, prices and availability shown on our website are accurate.

Colours and appearance may vary slightly depending on your screen, lighting and, where applicable, natural variations in materials or handmade production.

Prices and product availability may change without notice. The price applicable to your purchase is the price displayed and confirmed when you place your order, subject to correction of obvious errors.

Any applicable taxes, duties or other charges will be displayed or handled in accordance with the rules applicable to your order and destination.

3. Payment

Available payment methods are shown at checkout. Payment is processed using the payment method selected when you place your order.

You agree to provide current and accurate payment and billing information and confirm that you are authorised to use the payment method provided.

4. Shipping and Delivery

Available shipping methods, costs and estimated delivery times are shown at checkout where applicable.

Delivery times are estimates unless expressly stated otherwise. We are not responsible for delays outside our reasonable control, but this does not affect any statutory rights you may have.

You are responsible for providing a complete and accurate delivery address.

5. Cancellations, Returns and Refunds

Your rights and the process for cancelling an order, requesting a return or receiving a refund are described in our Returns, Cancellations and Refunds Policy, which forms part of these Terms.

Nothing in our return policy or these Terms limits any statutory right of withdrawal, cancellation, refund or remedy that applies to your purchase.

6. Damaged or Defective Products and Consumer Rights

If a product is damaged, defective, incorrect or otherwise does not conform to your purchase agreement, please contact us at hello@plantstraws.com so that we can make it right.

Consumers have the statutory rights and remedies provided by applicable consumer protection law. For consumers in Sweden, this includes the right to complain about an original defect for up to three years from receiving the product, subject to the requirements of applicable law.

These statutory rights apply independently of any voluntary return rights offered by Plantstraws.

7. Website Use and Intellectual Property

The content of this website, including text, photographs, graphics, product designs, logos and other material, is owned by or licensed to Plantstraws and is protected by applicable intellectual property laws.

You may use the website for personal and lawful purposes. You may not reproduce, distribute, commercially exploit or otherwise use our content without our permission, except where permitted by law.

You must not misuse the website, interfere with its operation or security, attempt to gain unauthorised access to it, or use it for any unlawful purpose.

8. Third-Party Services and Links

Our website may contain links to or use services provided by third parties, including services used for payments, shipping, analytics or other functionality.

Where you choose to use or interact with a third-party service, that service may be subject to its own terms and privacy practices.

9. Privacy

Our collection and processing of personal information is described in our Privacy Policy.

10. Business and Wholesale Purchases

This section applies when products are purchased from Plantstraws for business, wholesale or resale purposes (“B2B Purchases”). A customer making a B2B Purchase confirms that they are acting in the course of business and not as a consumer.

B2B orders are subject to our approval and may be agreed individually. We reserve the right to approve or decline wholesale customers and orders at our discretion.

Wholesale prices are quoted excluding VAT unless otherwise stated. VAT will be added where applicable. The business customer is responsible for providing complete and accurate company, billing and VAT information and for notifying us of any relevant changes.

Payment terms, order quantities, shipping charges and any other order-specific terms are those agreed in the relevant quotation, invoice, checkout or order confirmation. Unless expressly agreed otherwise, B2B shipping is charged separately and no consumer free-shipping offer applies.

B2B orders are final and are not covered by our consumer right of withdrawal or voluntary consumer return policy unless otherwise agreed in writing. This does not affect rights relating to defective, damaged or incorrectly supplied products.

Business customers should inspect deliveries upon receipt and notify us of visible damage, shortages or incorrect products without undue delay.

Where we provide a recommended retail price (RRP), it is a recommendation only. Resellers remain free to determine their own resale prices.

Approved resellers may sell Plantstraws products through their own retail stores and websites. Sale through third-party online marketplaces is not permitted unless expressly agreed by Plantstraws in writing.

Any terms specifically agreed between Plantstraws and a business customer in a quotation, invoice, order confirmation or other written agreement take precedence over this section to the extent that they conflict.

11. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so or limits any mandatory rights available to consumers.

To the extent permitted by applicable law, Plantstraws is not responsible for indirect or consequential losses that were not reasonably foreseeable when the purchase agreement was entered into.

For B2B Purchases, Plantstraws is not liable for indirect or consequential loss, including loss of profit, revenue or business, except where such limitation is prohibited by applicable law.

12. Governing Law and Disputes

These Terms and purchases from Plantstraws are governed by Swedish law.

If you are a consumer, this choice of law does not deprive you of any mandatory consumer protection rights you are entitled to under the laws of your country of residence.

If you have a complaint or dispute, please contact us first at hello@plantstraws.com so that we can try to resolve it.

Consumers in Sweden may also refer a dispute to Allmänna reklamationsnämnden (ARN), the Swedish National Board for Consumer Disputes, provided that the requirements for the Board to hear the dispute are met.

A dispute may also be brought before a competent court.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, services or applicable laws.

The Terms applicable to a purchase are the Terms in effect when the order is placed. Changes made after an order has been placed do not retroactively alter the terms of that purchase unless required by law or agreed with you.
